Town Attorney Grant Zajas Notifies Mauer That He Should Stop His Personalization Of Lake Erie Beach Park And Tells Mauer The Parks Department Is Capable Of Performing Needed Maintenance.

On August 8th, 1997, A Building Permit Was Issued To Build A House On A Substandard Lot. (Less Than 10,000 Sq Ft) The Permit Had A 00 Set Back Which Allowed The Property Owner To Build Right On The Property Line Of Lake Erie Beach Park! Any One That Has Built A Shed On Their Property Knows That You Have To Keep 10 From The Property Line. The New York State DEC Recommended That The Town Not Issue The Building Permit. This Permit Raises Many Issues. Why Wasnt The Lake Erie Beach Park Advisory Board Consulted Before The Permit Was Issued? . Why Wasnt The Recreation Advisory Board Consulted Before The Permit Was Issued? Why Didnt Supervisor Catalino Enforce The Zoning Laws The Rest Of The Residents Are Required To Abide By?

The Easement Gives The Property Owner The Above Rights But DOES NOT Take Away The Rights Of Other Town Residents To Use That Portion Of The Park. Why Hasnt Supervisor Catalino, The Town Board Or Wayne Conrad Investigated Complaints That This Property Owner Has Had His Lawyer Send A Neighbor A Letter Telling Him To Stay Off The Beach In Front Of His Property? Every One Has Beach Rights To 10 From The High Water Mark! Why Hasnt Supervisor Catalino, The Town Board Or Wayne Conrad Investigated Complaints That The Property Owner Has Threatened A Resident With Arrest For Riding His Bike Over The Pedestrian Bridge? Why Hasnt Supervisor Catalino, The Town Board Or Wayne Conrad Investigated Numerous Complaints That This Property Owner Is Chasing Residents Out Of Lake Erie Beach Park? Why Does Wayne Conrad Use Parks Funds Every Summer To Erect A Fence To Deter Residents From The Beach In Front Of This Property?

If You Build A House On The Property Line Of A Public Park, You Have To Expect To See Residents Using The Park Very Close To Your Property. Why Wont Supervisor Catalino Protect The Rights Of Town Residents To Use This Park?

What He Neglects To Take Into Consideration Is That Neighbor Problems At Lake Erie Beach Park Are Nothing New. In The 1940s, The New York State Supreme Court Decided How Neighbor Problems Should Be Resolved With Regards To Lake Erie Beach Park. The Court Said:

The Town Board Has Agreed To A Survey & Councilman Csati Has Agreed To Be The Point Man On Resolving Park Issues.

New Issue To Watch Is Oak Grove Property Owners With Deeds That Read To "The Waters Edge". These Most Recent Deeds Contain Language That Is Very Different From Deeds Files In The Past. If We Don't Watch These Creative Deeds Filings, We Could Lose Our Rights To Walk The Beach.
