1 TRUE! But Not For The Reasons The Town Board Would Have You Believe. Assemblyman Jack Quinn II With Not Alienate Any Lake Erie Beach Parklands Due To All The Questions & Unresolved Issues Surrounding The Park. The Town Board DID Have Wendel Engineers Draw Up A Proposed Settlement Plan Where A Portion Of Point Breeze Drive And Actual Parklands Were To Be Sold. The Plan Showed The Split Rail Fence Being Moved Five Feet To The West. The Parks Department Started Moving The Fence. 1-800-Underground Was Called To Mark Utilities. The Fence WAS NOT Put Back Up When Friends Of Evans Objected That The Town Was Not Negotiating The Park Resolution In Good Faith As Promised.
2 TRUE: The 1924 Deed Creating The Park & The 1987 Agreement (Filed With The Erie County Clerk In Liber 1739 Of Deeds At Page 91)

The 1924 Deed States: Said Streets, Avenues, Roads And Drives Are Always Maintained And Used As Public Highways By The General Public. Said Parks And Beaches Are Always To Remain Open To The Free Access, Use And Enjoyment Of The General Public. No Buildings Of Whatever Kind, Name Or Nature Are To Be Erected In Said Park Or Upon Any Of The Streets, Avenues, Roads And Drives Or On The Beach Without The Written Consent Of The Party Of The First Part Or Nor Are Any Concessions For The Use Of Any Said Parks Or Beaches For Other Than Park Purposes To Be Granted Without The Written Consent Of The Party Of The First Part.  
The 1987 Agreement Between The Lake Erie Beach Property Owners Association And The Town Of Evans (
Filed With The Erie County Clerk In Liber 9709 Of Deeds At Page 304) States That The Town Agrees To Maintain The Beaches and Parks Herein For Park Purposes. Further, The Agreement Is Not Intended To Affect The Rights Of Obligations Of Any Individual Or Entity.

This Deed And Agreement Is Why Lake Erie Beach Park Is
FREE AND OPEN TO THE PUBLIC

3 The Town's New Survey Is Different For The Survey The Property Owner Submitted To The Town. The Town's Survey Does Show The Property Owner's Fence Over The Property Line And On An Adjacent Neighbor's Property. There Is No Easement For The Residential Lights Along Point Breeze Drive, Some Of Which Are On Another Neighbor's Property.

  Supervisor Catalino Created There Park Problems. Councilman Tom Csati, The Liason To The Lake Erie Beach Advisory Board Hasn't Held A Board Meeting Since April 2004. Councilwoman Karen Erickson Proposed The Sale Of Point Breeze Drive (In Public, Before A Group Of People) Now Denies Any Such Plan Ever Existed)

The Big Question: Why Did The Councilwoman (Bartus), With The Least Background On This Park Issue, Sign The Town Board's Ad In The Penny Saver. The Supervisor Created The Problem. He Should Have Signed It. Are Csati & Erickson Trying To Hide From This Issue In A Re-Election Year?
