Built His House over the Property Line into Lake Erie Beach
Park. Since the Town Board Has Demonstrated a Willingness to
Sell off Lake Erie Beach Parklands in Violation of New York
State Law and Without Full Public Disclosure or a Public
Hearing, a Local Resident Has Hired an Attorney for the
Purpose Blocking Another Sale in the Dead of Night.
The Town Board Likes to Pat Itself on the Back
for its Willingness to Deal with the Tough Issues. This
Property Owner May Have "Informally Annexed" 60 Feet of
Parklands for His Exclusive Use. The Town Board Has Chosen to
Ignore Reports That this Property Owner Has Chased Residents
off Public Property Including the Public Picnic Shelter Near
Old Lake Shore Road.
The Town Boards Current Misguided Plan it to
Sell the Offending Property Owner All of Point Breeze Drive
and about 60 Feet of Parklands Next to the Property Owners
House.
Since Point Breeze Drive Has a Historic Use
as a Right of Way Providing Residents and Boat Owners Access
to Lake Erie, Given the Town Board Has Stonewalled this Issue
since 1998, Action Had to Be Taken to "Encourage" the Evans
Town Board to Act in the Publics Best Interest. To Establish
Value For Point Breeze Drive, To Minimize Another Sale of Lake
Erie Beach Parklands, An Initial Bid Of $500.00 Has Been Made
For Point Breeze Drive. Since Local Law Regarding The Sale Of
Paper Roads Requires The Paper Road To "Have No Value" To The
Town, This Establishes A Value For Point Breeze Drive.
The Town Boards New Years Resolution Should
Be to Resolve this Issue with Full Public Disclosure as Soon
as Possible. Having the Property Line Re-surveyed Should Be
the First Action They Authorize.
